Ben Ginsberg on Equal Protection

Today, former Senator Coleman’s legal team filed its appeal of the Minnesota Election Court’s decision recognizing Senator-elect Franken as the winner of last November’s Senate election.  Foremost among Coleman’s claims is the assertion that Franken’s victory somehow violates the Equal Protection Clause.

Of course, this reminds me of a speech Coleman’s attorney, Ben Ginsberg, gave a few years ago while I was still in law school.  In that speech, Ginsberg candidly admitted that (link is an old Real Player file.  Quote is at 38:52):

Just like, really, with the Voting Rights Act, Republicans have some fundamental philosophical difficulties with the whole notion of Equal Protection.
